Terms of Service

1. Provider

The ForgeGuard AI service ("Service") is provided by ferdinand industriales ("we", "us"). By using the Service, you ("User") enter into a contract with ferdinand industriales.

2. Acceptance

By creating an account, accessing or continuing to use the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm you are of legal age and, if acting on behalf of an organisation, that you have authority to bind it.

3. The Service

ForgeGuard AI provides AI-assisted industrial maintenance tools: diagnostics, predictive analytics, reporting, document search and related features. Features may evolve over time.

4. Acceptable Use

You must not misuse the Service. This includes, without limitation: unlawful use, fraud, spam, infringement of intellectual property, interference with security (malware, probing, scraping), reverse engineering, resale or redistribution, or circumventing technical limits.

5. Intellectual Property

We retain all rights, title and interest in the Service, including software, documentation, branding and AI models. You receive a limited, non-exclusive, non-transferable right to use the Service within your subscribed plan. You retain ownership of content you upload and grant us a limited licence to host and process it solely to provide the Service.

6. Payments, Subscriptions and Taxes — Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, invoicing, cancellation and refund mechanics are governed by the Paddle Checkout Buyer Terms.

7. Service Level

The Service is provided "as is". We do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law we disclaim all implied warranties of merchantability and fitness for a particular purpose. AI outputs may be inaccurate and must be verified by a qualified professional before use in safety-critical contexts.

8. Liability

To the extent permitted by law, our aggregate liability for any claim is capped at the fees you paid us in the 12 months preceding the claim. We exclude liability for indirect, consequential or special damages (including loss of profits, data or goodwill). Nothing limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.

9. Suspension and Termination

We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may terminate by cancelling your subscription via Paddle. Upon termination, you may export your data within 30 days, after which it may be deleted.

10. Indemnity

You will indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

11. Changes

We may update these Terms. Material changes will be notified via the Service or by email and take effect after a reasonable notice period.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which ferdinand industriales is established, without prejudice to mandatory consumer protections in your country of residence.
